1. Agreement to Terms

These Terms & Conditions ("Terms") govern your use of the Cradle Safaris website and your booking of any tour, safari, or travel-related service offered by Cradle Safaris ("we", "us", "our"). By browsing this website, creating an account, or booking a tour, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or services.

2. Bookings & Payment

All bookings are subject to availability and confirmation by Cradle Safaris. A deposit or full payment (as specified at the time of booking) is required to secure your reservation. Prices displayed on the website are indicative and may be subject to change until a booking is confirmed in writing.

• Full payment must be received before the start date of the tour, within the timeframe communicated during booking.
• We accept payment via the methods listed at checkout or communicated directly by our team.
• Prices are quoted per person unless otherwise stated, and may exclude items such as international flights, visas, travel insurance, and personal expenses.

3. Cancellations & Refunds

Cancellations must be submitted in writing to our team. Refunds, where applicable, are calculated based on how far in advance of the tour start date the cancellation is received. Cancellation fees may apply and will be communicated to you at the time of booking or upon request.

• Cancellations made well in advance of the tour date may be eligible for a partial refund, less any non-recoverable costs already incurred (e.g. park fees, accommodation deposits).
• Cancellations made close to the tour start date may not be eligible for a refund.
• No refunds will be issued for no-shows or early departures from a tour already in progress.

4. Changes to Itineraries

While we make every effort to operate tours as advertised, itineraries may be adjusted due to weather, road conditions, wildlife movement, park regulations, or circumstances beyond our control. Cradle Safaris reserves the right to modify routes, accommodations, or activities where necessary, while aiming to preserve the overall quality and value of your trip.

5. Travel Documents & Health Requirements

It is the traveler's responsibility to ensure they hold a valid passport, any required visas, and to meet health requirements (including vaccinations) for the countries visited on their tour. Cradle Safaris is not liable for any loss, delay, or additional cost arising from a traveler's failure to hold the correct documentation.

6. Liability

Cradle Safaris acts as an organizer of tours and works with third-party providers including accommodations, transport operators, and local guides. While we carefully select our partners, we are not liable for any injury, loss, damage, delay, or inconvenience caused by circumstances beyond our reasonable control, or by the acts or omissions of third-party service providers.

We strongly recommend all travelers obtain comprehensive travel insurance covering medical expenses, trip cancellation, and personal belongings before departure.

7. Traveler Conduct

Travelers are expected to follow the guidance of their tour guide and respect local laws, customs, and wildlife safety instructions at all times. Cradle Safaris reserves the right to remove a traveler from a tour, without refund, if their conduct endangers themselves, other travelers, staff, or wildlife.

8. Force Majeure

Cradle Safaris shall not be held responsible for any failure to perform its obligations where such failure is caused by circumstances beyond its reasonable control, including but not limited to natural disasters, extreme weather, political unrest, pandemics, government travel restrictions, or acts of terrorism.

9. Use of This Website

All content on this website — including text, images, logos, and branding — is the property of Cradle Safaris unless otherwise credited, and may not be reproduced or used without prior written permission. You agree to use this website only for lawful purposes and not to interfere with its security or normal operation.

10. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services or for legal and regulatory reasons. The latest version will always be available on this page, and continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Kenya. Any disputes arising from these Terms or your booking with Cradle Safaris shall be subject to the exclusive jurisdiction of the courts of Kenya.
